References in these Terms and Conditions to "Takashimaya" or "we" or “our” or "us" refers to Takashimaya Singapore Ltd (UEN: 19892636N), a company incorporated in Singapore and having its registered office at 391A Orchard Road, #10-01 Ngee Ann City Tower A, Singapore 238873.
1. Your Account
1.1 You warrant that all information you provide is accurate and complete at all times.
1.2 By placing an order through our site you warrant that you are legally capable of entering into binding contracts.
1.4 You may not use this website for any commercial purpose.
2. Merchandise Availability
2.1 All food and hamper products are subject to availability and we reserve the right to substitute products of equivalent value without prior notice in the event the stated products are sold out.
2.2 In the event that an item you have chosen becomes unavailable after you have confirmed your order, we will notify you via email.
3. Product Information
3.1 Every care has been taken to ensure that the photographic representation, description and specification of each product are accurate. However, while the reproduction of colours is a close representation, a slight variation in the actual goods may occur. We are therefore unable to guarantee that the product images you see are an accurate representation of the actual merchandise.
4. Order Policy
4.1 You may place an order by registering for an account on the website. You must follow the instructions on the website as to how to make your order and for making changes to your prospective order before you submit it to the Site.
4.2 Once you select a product that you wish to order, you will see the charges you must pay including GST, if applicable, and any applicable delivery charges. Unless otherwise stipulated on the website, all charges shown are in Singapore Dollars.
4.3 Full payment must be made at the time of ordering with your credit or debit card acceptable to us. You must be fully entitled to use that card and that there are sufficient funds or credit facilities to cover the cost of the Product. We reserve the right to validate your payment details before providing you with the product.
4.4 We shall not be obliged to supply the Product to you until we have accepted your Order. Your order is deemed acknowledged when you receive an Order Confirmation from us via email. In that Order Confirmation, we may give you an order number and details of the product you have ordered. We may in our discretion refuse to accept an order from you for any reason, including unavailability of supplies.
4.5 We will ensure that the price given to you is accurate, but the price of your order will need to be validated by us as part of our acceptance procedure. If the price for the Order changes before we accept your Order, we will contact you and ask you to confirm that you wish to proceed at the amended price.
5. Cancellation of Order
5.1 We do not accept any cancellation or modification after the order has been accepted and confirmed.
5.2 Notwithstanding that the Order has been accepted and confirmed, we reserve the right to cancel the Order or any part thereof at any time without giving you any reasons. In the event of a cancellation we will inform you via email and refund you accordingly without interest.

8. Fraud Protection Policy
We reserve the right to refuse to process an order due to suspected fraud or unauthorized or illegal activity. If such is the case, we may reject your order. We also reserve the right to cancel any accounts or refuse to deliver to certain addresses due to suspected fraud or unauthorized or illegal activity. We take these measures to protect our customers as well as ourselves from fraud or other unauthorized or illegal activity.
All prices stated on Takashimaya Online Store are in Singapore Dollars unless otherwise stated.
10. Return & Exchange Policy
10.1 You are strongly advised to check the Product purchased at the time of delivery. All Products leaving Takashimaya’s distribution centre have been checked for quality and quantity accuracy.
10.2 We do not offer returns, exchange or refunds on online purchases.
11. Refund Policy
11.1 If you have been charged for a product which has not been delivered, Takashimaya will give you the option of proceeding with your order at the same price or cancelling it. If Takashimaya is unable to contact you, we will treat the order as cancelled, and you will be refunded accordingly.
11.2 If you are being charged more than the value of the Product you ordered, Takashimaya shall refund you the difference.
11.3 All refunds will either come in the form of Credit Vouchers or be credited without interest into the same credit card that was used for the Order. Please note that it takes approximately 14 days for a credit return to your card to be effective. Takashimaya shall not be liable for any damage loss or inconvenience of any form suffered whatsoever arising from any discrepancy.
12. Disclaimer of Warranties; Limitation of Liabilities
12.1 The website and the materials are presented "as is”, “as available” basis only. To the fullest extent permissible pursuant to applicable law, Takashimaya disclaims all warranties, express or implied, including, but not limited to, implied warranties of satisfactory quality, merchantability or fitness for a particular purpose, compliance with description or the warranty of non-infringement.
12.2 We do not warrant that the website, its content or the server(s) that make it available are error or virus free or free of other harmful components or that your use of this website will be uninterrupted.
12.3 We do not warrant that the quality of any products that you purchase through this website will meet your expectations.
12.4 Both Takashimaya and its delivery contractor shall not be held responsible for any damage or loss of Products after delivery. The Customer shall ensure that the Products are not used for any purpose for which they are not suitable and shall be responsible for using all necessary skill and care in handling and using the Products. The Customer expressly acknowledges and agrees that Takashimaya assumes no obligation or liability for any advice or information given with the Products and Takashimaya shall not be responsible for any inaccuracy or misstatement of any such information. The Customer assumes all risks connected with the use and storage of the Product.
12.5 In no way will Takashimaya be liable for any damages, including without limitation direct or indirect, special, incidental, or consequential damages, losses or expenses arising in connection with this site or use thereof or inability to use by any party, or reliance on the contents of this site, or in connection with any failure of performance, error, omission, interruption, defect, delay or failure in operation or transmission, computer virus or line or system failure, even if Takashimaya, its representatives, are advised of the possibility of such damages, losses or expense, hyperlinks to other internet resources are at your own risk; the content, accuracy, opinions expressed, and other links provided by these resources are not investigated, verified, monitored, or endorsed by us. This exclusion clause shall take effect to the fullest extent permitted by law.
13. Governing Law
By accessing this website and obtaining the facilities, products or services offered through this website, you agree that Singapore law shall govern such access and the provision of such facilities, products and services and you agree to submit to the exclusive jurisdiction of the Singapore courts.
14. Third Parties Rights
A person who is not a party to any agreement governed by the Terms and Conditions has no right under the Contracts (Rights of Third Parties) Act (Chapter 53B) to enforce any of the terms of such agreement.
